Error 404

I am just making a new site live using 5.5.2.1 with a custom theme and I seem to be having problems with the C5 install returning a 404 for non existent pages.
Although the theme is custom the 404 has not been skinned and is still the system one but returns a 200 when a non existent page is requested.
Has anyone come across this before?

Just noticed that this is a reported bug so hopefully it will get fixed.
